Studi Web S.r.l. through the "bipen.it" service on the website www.bipen.it offers personalised gadgets for sale.

Product Characteristics

All items for sale bear the original BIC brand and are manufactured by the parent company BIC Graphic Europe. All product trademarks and their names are registered and belong to BIC Graphic Europe, licensed to Studi Web S.r.l. The Bi.Pen trademark is a registered trademark belonging to Studi Web.

Conclusion of the Contract

The contract is concluded by sending the purchase order, containing the description of products and quantities, to the supplier.

The order may be placed by the following means:

• the bipen.it website;
• the dedicated web page linked to the bipen.it website;
• sending the stamped and signed order by ordinary email;
• a negotiation conducted through the exchange of ordinary emails between the supplier and the customer;
• the exchange of communications via chat channels such as, by way of example only, "WhatsApp".

Placing the order implies acceptance of these terms and conditions.

Personalisation of Goods

Following receipt of the order, the supplier will contact the customer to agree on the personalisation method. The product will only go into production once the customer has approved the graphic design.

Any changes or support requests must be submitted by email to ordini@bipen.it.

The supplier Studi Web S.r.l. will provide technical support during the personalisation phase, through a team of professionals always available to develop a product that respects the customer's corporate identity and/or requirements. Standard printing will be horizontal and right-handed.

Should the supplier deem it necessary to make changes to ensure the optimal finish of the personalised product — such as a white underprint beneath the specified Pantone colour — the supplier will immediately contact the customer to agree the additional cost of the intervention and obtain consent.

The customer's refusal to consent shall not constitute valid grounds for contract termination. In such case, the customer personally assumes the risk that the personalised product may have illegible or poorly defined printing.

The customer's final approval shall be deemed definitive and will be sent to print. The customer undertakes to cooperate with the supplier and, in particular, to provide the required print files in vector graphic format, such as (by way of example): PDF, CDR, AI.

If the customer does not have the file in one of the required formats, the supplier may independently process and convert the received file into vector format for printing, subject to prior notification of the additional cost.

In the case of printing images or photographs, the customer undertakes to provide high-resolution files; otherwise, the customer bears full responsibility for any poor print quality.

The Customer is solely responsible for the use, accuracy, legality, correctness and right of use of the material, information, texts, images, trademarks and logos provided by the Customer for use in personalising the products.

Online Catalogue Illustrations

The logos and other prints shown in the catalogue and on web pages are for demonstration purposes only. Product colours displayed on screen may vary slightly from the original due to the limitations of photography and various factors arising from the printing process, film separation and plastics.

By accepting these terms and conditions, the customer expressly authorises Studi Web S.r.l. and BIC Graphic Europe to use images and samples of the customer's personalised products for purely advertising purposes.

The customer retains the right to expressly refuse consent to the use of images and samples at the time of placing the order.

Prices

All sale prices of products displayed on the website are exclusive of VAT.

The total cost inclusive of VAT and shipping will be shown before payment is processed.

Payment Methods

Prepayment via PayPal (any credit card can be used on PayPal even without a registered account) or bank transfer payable to Studi Web S.r.l. – Via Nicolò Sergio De Bellis, 15 70013 Castellana Grotte (BA) – IBAN: IT14R0846941440000000014826. Please state in the payment reference: payment bi.pen plus your personalisation brand name, or the invoice number and date received.

Instalment payments are permitted through the channels made available by the company, only if expressly authorised by the company. The customer must also be approved by the instalment payment circuit, such as (by way of example): PayPal Pay in 3.

To speed up the processing time, the Customer must send a copy of the bank receipt showing the CRO traceability code to the email address ordini@bipen.it or info@bipen.it.

Delivery / Lead Times

Purchased goods will be delivered by express courier selected by the supplier. Delivery times, starting from proof approval, are indicatively between 15 and 20 working days.*

The supplier reserves the right to supply 5% more or less than the ordered quantity for printed orders.

Complaints

The Customer must report, under penalty of forfeiture, any defects in the supply (non-conformity with the approved proof, malfunctioning of items) within 7 days from the date of delivery, by registered letter addressed to the above address or by certified email (PEC) to info@pec.studiweb.it. After this period, the items shall be deemed accepted. The supplier will take action and acknowledge any liability for error only for complaints submitted in writing and accompanied by samples. The number of samples required to initiate a complaint is at least 10% of the total supply.

The product must be shipped at the Customer's expense and responsibility for replacement; however, if the disputed item is not returned in the same condition as received — i.e. in perfect condition, unused, with original packaging and any manuals, without any missing elements — Studi Web S.r.l. will consider the purchase accepted by the Customer. Studi Web S.r.l. reserves the right to charge the customer for any costs incurred for product inspection and return shipping, should the product prove to be intact and functioning, contrary to the customer's claim.

Warranty

Products sold are warranted only for their intended use. Any defect or deterioration caused by improper use, external agents, or modifications not foreseen by the manufacturer will void the warranty.

The purchaser declares and warrants that the purchased product will not be used for printing "reprehensible" messages or designs. The Customer declares and warrants that the messages used for personalisation do not infringe any intellectual property or personal rights of third parties. As such, the Customer indemnifies the Supplier against any actions, claims or legal proceedings brought by anyone who may consider themselves harmed by the printing and personalisation requested by the Customer. This indemnity shall apply to all damages, costs, expenses and taxes that may arise.

Applicable Law. Jurisdiction

The contract is entirely governed by Italian law, which regulates its conclusion, performance and termination, and under which it shall be interpreted, including for the purpose of resolving any disputes arising from it. Any dispute arising from or in any way connected, directly or indirectly, with the interpretation or performance of this contract, including any third-party actions involving the Company, shall fall within the exclusive jurisdiction of the Court of Bari, to the exclusion of any other court.

Privacy

Personal data provided during the order process is processed by Studi Web S.r.l. as data controller, pursuant to EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018. Data is collected and processed exclusively for the performance of the contract and for the tax and accounting obligations required by law.
